數(shù)據(jù)處理者社會(huì)責(zé)任的正當(dāng)基礎(chǔ)與內(nèi)容體系

摘要: 數(shù)據(jù)處理者作為數(shù)字時(shí)代發(fā)展的“靈魂人物”,,掌握著數(shù)據(jù)這一核心經(jīng)濟(jì)引擎,,無(wú)論從其內(nèi)生驅(qū)動(dòng)還是外部期望角度,,要求其承擔(dān)社會(huì)責(zé)任均具有正當(dāng)性,。企業(yè)社會(huì)責(zé)任的基礎(chǔ)性問(wèn)題包括由誰(shuí)負(fù)責(zé),、對(duì)誰(shuí)負(fù)責(zé),、負(fù)責(zé)什么和負(fù)責(zé)到什么程度,,而現(xiàn)有立法對(duì)后兩者問(wèn)題明顯回應(yīng)不足,。故為厘清數(shù)據(jù)處理者社會(huì)責(zé)任的基本內(nèi)容,,應(yīng)當(dāng)遵循“兩步法”,即在責(zé)任內(nèi)容上,,明確其內(nèi)涵限于法律責(zé)任與道德責(zé)任兩方面,;在責(zé)任范圍上,構(gòu)建擔(dān)責(zé)的“必須而為”“能為盡為”“量力而為”三層級(jí)框架,。以此為基礎(chǔ),,進(jìn)一步細(xì)化各層級(jí)責(zé)任的具體內(nèi)容,可以構(gòu)建系統(tǒng)的數(shù)據(jù)處理者社會(huì)責(zé)任內(nèi)容體系,,從而實(shí)現(xiàn)數(shù)據(jù)處理者社會(huì)責(zé)任實(shí)踐的有效治理,。

The legitimate basis and content system of social responsibility of data processors

Abstract: As the "key figures" in the development of the digital era, data processors hold the core economic engine of data. Whether from the perspective of their internal drive or external expectations, it is justifiable to require them to undertake social responsibilities. The fundamental issues of corporate social responsibility encompass who is accountable, to whom they are accountable, for what, and to what extent. However, the existing legislation evidently responds inadequately to the latter two issues. Therefore, to clarify the basic content of the social responsibilities of data processors, a "two-step approach" should be adopted: Firstly, in terms of the content of responsibility, it should be explicitly stipulated that it is confined to legal and moral responsibilities; Secondly, in terms of the scope of responsibility, a three-level framework of "obligatory actions", "actions within capacity", and "actions based on capabilities" should be constructed. On this basis, by further detailing the specific contents of each level of responsibility, a systematic content system of social responsibility for data processors can be established, providing a beneficial reference for the effective governance of their social responsibilities.

引言

第三次工業(yè)革命催生了信息化與智能化的深度融合,,帶來(lái)了數(shù)字經(jīng)濟(jì)的崛起,深刻影響了各行各業(yè)的轉(zhuǎn)型與發(fā)展,。在這一背景下,,數(shù)據(jù)處理者作為數(shù)字經(jīng)濟(jì)的核心參與者,其社會(huì)話語(yǔ)權(quán)與影響力也隨著數(shù)字化浪潮的不斷推進(jìn)得到顯著提升,,業(yè)已成為市場(chǎng)經(jīng)濟(jì)中舉足輕重,、不容忽視的主體。因而,,數(shù)據(jù)處理者是否應(yīng)當(dāng)承擔(dān)社會(huì)責(zé)任以及應(yīng)當(dāng)承擔(dān)何種社會(huì)責(zé)任亦作為事關(guān)經(jīng)濟(jì)發(fā)展與民生福祉的重大問(wèn)題,,亟待解決。

2024年6月,,國(guó)務(wù)院發(fā)布了《關(guān)于新時(shí)代中央企業(yè)高標(biāo)準(zhǔn)履行社會(huì)責(zé)任的指導(dǎo)意見(jiàn)》(以下簡(jiǎn)稱《指導(dǎo)意見(jiàn)》),明確了中央企業(yè)應(yīng)履行的十七項(xiàng)社會(huì)責(zé)任,并為其他市場(chǎng)主體提供了重要的參考框架,。然而《指導(dǎo)意見(jiàn)》主要是從宏觀視角作出部署,,其仍未能為數(shù)據(jù)處理者社會(huì)責(zé)任履責(zé)實(shí)踐中面臨的新興問(wèn)題提供具體解決方案。鑒于傳統(tǒng)工業(yè)經(jīng)濟(jì)框架下的企業(yè)社會(huì)責(zé)任理論已逐漸顯示出局限性[1],,因而要對(duì)前述問(wèn)題予以確切解答,,還需回歸對(duì)《民法典》《個(gè)人信息保護(hù)法》《數(shù)據(jù)安全保護(hù)法》等現(xiàn)行規(guī)范的深入探討。

基于此,,本文擬從企業(yè)社會(huì)責(zé)任的經(jīng)典理論出發(fā),,結(jié)合我國(guó)現(xiàn)行法律規(guī)范、社會(huì)政策的觀點(diǎn),,對(duì)數(shù)據(jù)處理者承擔(dān)社會(huì)責(zé)任的正當(dāng)基礎(chǔ)進(jìn)行多視角分析,,并明確數(shù)據(jù)處理者社會(huì)責(zé)任的具體內(nèi)容邊界,構(gòu)建系統(tǒng)的社會(huì)責(zé)任內(nèi)容體系,,以期為豐富和完善數(shù)字經(jīng)濟(jì)時(shí)代下的企業(yè)社會(huì)責(zé)任理論,、推動(dòng)數(shù)據(jù)要素治理格局的科學(xué)建立提供有益參考。
